if I select ".\all.m3u" as output file, create a playlist, choose anyother working directory and try to create another playlist file mp3 tag studio still asks me if I want to overwrite my old playlist -> this question should not be asked since nothing is overwritten.

Only absolute paths to the list is currently supported. You can use the global settings to automatically update your list path every time you change the working dir instead, resulting in the exact behavior you want.
